According to the report, Jamaal Howard, 46, is scheduled for execution in Texas on October 7 for killing petrol station worker Vicky Swartout during a 2000 robbery in Silsbee.

His spiritual adviser, Dr. Jeff Hood, says Howard is intellectually disabled and does not grasp that lethal injection will end his life.

Hood described conversations in which Howard allegedly confused execution drugs with intoxicants and suggested the warden would shoot him if the injection failed.

Those accounts underpin Hood’s concern, but they are not themselves a judicial finding about Howard’s competency. The report says Howard’s lawyers have sought an evidentiary hearing to examine whether he understands his punishment, a question with constitutional consequences.

Swartout’s killing remains central to the case, alongside the state’s responsibility to administer punishment lawfully.

For Hood, the immediate fear is accompanying Howard into the execution chamber and discovering that he still cannot comprehend what is happening to him.
